Terms and Conditions of Processing a Course Registration
New Mexico State University Financial Responsibility Agreement

By processing a course registration either via the Web or by submitting a Change of Schedule Form to an academic student registration area, a student acknowledges they have read and agree to the following terms and conditions:
PAYMENT OF FEES/PROMISE TO PAY
I understand that when I register for any class at New Mexico State University or receive any service from New Mexico State University I accept full responsibility to pay all tuition, fees and other associated costs assessed as a result of my registration and/or receipt of services. I further understand and agree that my registration and acceptance of these terms constitutes a promissory note agreement (i.e., a financial obligation in the form of an educational loan as defined by the U.S. Bankruptcy Code at 11 U.S.C. §523(a)(8)) in which New Mexico State University is providing me educational services, deferring some or all of my payment obligation for those services, and I promise to pay for all assessed tuition, fees and other associated costs by the published or assigned due date.)
I understand that when I register for classes at New Mexico State University, I assume the responsibility for understanding the University’s official policies concerning schedule changes, satisfactory academic progress and the financial policies of the University as described in the New Mexico State University undergraduate and graduate catalogs. New Mexico State University catalogs can be found at https://catalogs.nmsu.edu/.
I understand and agree that if I drop or withdraw from some or all of the classes for which I register, I will be responsible for paying all or a portion of tuition and fees in accordance with the published tuition refund schedule at https://uar.nmsu.edu/refunds/withdrawals.html. I have read the terms and conditions of the published tuition refund schedule and understand those terms are incorporated herein by reference. I further understand that my failure to attend class or receive a bill does not absolve me of my financial responsibility as described above.
STUDENT ACCOUNT
I understand and agree that it is my responsibility to keep track of my account balance and funding sources.
PAYMENT PLAN
I understand that I have the option to pay my tuition bill over the course of the semester by enrolling in the New Mexico State University payment plan. By enrolling in the New Mexico State University payment plan, the following terms apply:
- Enrollment available on accounts with a current semester balance greater than $200.00
- 10% down payment due at the time of enrollment
- Fall/Spring semesters will have 5 payments and the summer semester will have 3 payments
- Remaining payments due the 15th of each month
- A $10 fee will be assessed for late, partial, or missed payments
Students who do not enroll in the payment plan by the deadline will be assessed a $25 service fee and a .5% monthly fee on any outstanding balance not paid in full by the 15th of each month. The NMSU Payment Plan does not exempt the student from meeting the prior term balance at the time of registration. The Payment Plan is a separate agreement with NMSU.
REGISTRATION OF FUTURE TERMS/CANCELLATION OF COURSES
New Mexico State University reserves the right to prohibit or cancel registration of any student who fails to pay, when due, any indebtedness to the institution. The NMSU Payment Plan does not exempt the student from meeting the prior term balance at the time of registration. The Payment Plan is a separate agreement with NMSU.
DELINQUENT ACCOUNT/COLLECTION
Billing: Students not currently enrolled but have an outstanding balance due to the university will be billed monthly with billing statements mailed to the current address on record.
Financial Hold: I understand and agree that if I fail to pay my student account bill or any monies due and owing New Mexico State University by the scheduled due date, New Mexico State University will place a financial hold on my student account, preventing me from registering for future classes or receiving my diploma.
Collection Agency Fees: I understand and accept that if I fail to pay my student account bill or any monies due and owing New Mexico State University by the scheduled due date, and fail to make acceptable payment arrangements to bring my account current, New Mexico State University may refer my delinquent account to a collection agency. I further understand that if New Mexico State University refers my student account balance to a third party for collection, whether an attorney or collection agency, I will be responsible for any costs (including but not limited to collection fees, attorney’s fee, and court costs) associated with attempting to collect the monies due and owing. I understand a collection fee will be assessed and will be due and owing in full at the time of the referral to the third party. The collection fee will be calculated at the maximum amount permitted by applicable law. For purposes of this provision, the third party may be a debt collection company or an attorney. If a lawsuit is filed to recover an outstanding balance, I shall also be responsible for any costs associated with the lawsuit such as court costs or other applicable costs. Finally, I understand that my delinquent account may be reported to one or more of the national credit bureaus.
Lawsuits: If New Mexico State University prevails in a lawsuit to collect on this financial obligation, Student will pay New Mexico State University’s court costs, collection agency costs, and attorney fees in an amount the court finds to be reasonable.
DISPUTE RESOLUTION
Governing Law: This Agreement will be governed by and construed in accordance with the laws of the State of New Mexico. I agree that any legal action or proceeding with respect to this Agreement will be brought exclusively in the District Courts of Doña Ana County, New Mexico or in the United States District Court of New Mexico and I agree to the exclusive jurisdiction of those courts.
Mediation: The student and New Mexico State University agree to attempt in good faith to resolve any conflicts, disputes or claims arising out of this Agreement. If applicable, the parties agree to consider the utilization of Alternative Dispute Resolution (ADR) procedures.
COMMUNICATION
Method of Communication: I understand and agree that New Mexico State University uses nmsu.edu e-mail as the official method of communication with me, and therefore I am responsible for reading the e-mails I receive from New Mexico State University on a timely basis.
Contact: I authorize New Mexico State University and its agents and contractors to contact me at my current and any future cellphone number(s), email address(es) or wireless device(s) regarding my delinquent student account(s)/loan(s), any other debt I owe to New Mexico State University or to receive general information from New Mexico State University. I authorize New Mexico State University and its agents and contractors to use automated telephone dialing equipment, artificial or pre-recorded voice or text messages, and personal calls and emails in their efforts to contact me. Furthermore, I understand that I may withdraw my consent to call or text my cellphone using automated telephone dialing equipment by submitting a clear revocation request in writing to New Mexico State University – University Accounts Receivable or in writing to the applicable contractor or agent contacting me on behalf of New Mexico State University.
Updating Contact Information: I understand and agree that I am responsible for keeping New Mexico State University records up to date with my current mailing addresses, email addresses, and phone numbers by logging into myNMSU and selecting Personal Information. The linked procedure is incorporated herein by reference. Upon leaving New Mexico State University for any reason, it is my responsibility to provide New Mexico State University with updated contact information for purposes of continued communication regarding any amounts that remain due and owing to New Mexico State University.
FINANCIAL AID
I understand that aid described as “estimated” on my Financial Aid Award does not represent actual or guaranteed payment, but is an estimate of the aid I may receive if I meet all requirements stipulated by that specific aid program.
I understand that my Financial Aid Award is contingent upon my continued enrollment and attendance in each class upon which my financial aid eligibility was calculated. If I drop any class before completion, I understand that my financial aid eligibility may decrease and some or all of the financial aid awarded to me may be revoked.
If some or all of my financial aid is revoked because I dropped or failed to attend class, I agree to repay all revoked aid that was disbursed to my account and resulted in a credit balance that was refunded to me.
I agree to allow financial aid I receive to pay any and all charges assessed to my account at New Mexico State University such as tuition, fees, campus housing and meal plans, student health insurance, parking permits, service fees, fines, bookstore charges, or any other amount, in accordance with the terms of the aid.
Federal Aid: I understand that any federal Title IV financial aid that I receive, except for Federal Work Study wages, will first be applied to any outstanding balance on my account for tuition, fees, room and board, bookstore charges, and any other education related charges. Title IV financial aid includes aid from the Pell Grant, Supplemental Educational Opportunity Grant (SEOG), Direct Loan, PLUS Loan, and TEACH Grant programs.
Prizes, Awards, Scholarships, Grants: I understand that all prizes, awards, scholarships and grants awarded to me by New Mexico State University will be credited to my student account and applied toward any outstanding balance. I further understand that my receipt of a prize, award, scholarship or grant is considered a financial resource according to federal Title IV financial aid regulations, and may therefore reduce my eligibility for other federal and/or state financial aid (i.e., loans, grants, Federal Work Study) which, if already disbursed to my student account, must be reversed and returned to the aid source.
METHOD OF BILLING
I understand that New Mexico State University uses electronic billing (e-bill) as its official billing method for currently enrolled students, and therefore I am responsible for viewing and paying my student account e-bill by the scheduled due date. I further understand that failure to review my e-bill does not constitute a valid reason for not paying my bill on time. E-bill information is available on this page.
BILLING ERRORS
I understand that administrative, clerical or technical billing errors do not absolve me of my financial responsibility to pay the correct amount of tuition, fees and other associated financial obligations assessed as a result of my registration at New Mexico State University.
RETURNED PAYMENTS/FAILED PAYMENT AGREEMENTS
If a payment made to my student account is returned by the bank for any reason, I agree to repay the original amount of the payment plus a returned payment fee of $25. I understand that multiple returned payments and/or failure to comply with the terms of any payment plan or agreement I sign with New Mexico State University may result in cancellation of my classes and/or suspension of my eligibility to register for future classes at New Mexico State University.
WITHDRAWAL
If I decide to completely withdraw from New Mexico State University, I will follow the instructions at https://uar.nmsu.edu/refunds/withdrawals.html which I understand and agree are incorporated herein by reference.
PRIVACY RIGHTS & RESPONSIBILITIES
I understand that New Mexico State University is bound by the Family Educational Rights and Privacy Act (FERPA) which prohibits New Mexico State University from releasing any information from my education record without my consent.Therefore, I understand that if I want New Mexico State University to share information from my education record with someone else, I must designate that person as a proxy by following the procedure outlined at Student User Instructions. I further understand that I may revoke my permission at any time as instructed in the same procedure.
IRS FORM 1098-T
I agree to provide my Social Security number (SSN) or taxpayer identification number (TIN) to New Mexico State University upon request as required by Internal Revenue Service (IRS) regulations for Form 1098-T reporting purposes. If I fail to provide my SSN or TIN to New Mexico State University, I agree to pay any and all IRS fines assessed as a result of my missing SSN/TIN.
STUDENT AGE
I understand and agree that if I am younger than the applicable age of majority when I execute this agreement that I am doing so for the purposes of furthering my education at an institution of higher learning and that, pursuant to Section 58-6-3 of the New Mexico Statutes Annotated, 1978 as amended, this Agreement will be enforceable against me with the same effect as if I had, at the time of its execution, reached the age of majority.I also agree that the educational services provided by New Mexico State University are a “necessity” for which I am contractually obligated.
ENTIRE AGREEMENT
This agreement supersedes all prior understandings, representations, negotiations and correspondence between the student and New Mexico State University, constitutes the entire agreement between the parties with respect to the matters described, and shall not be modified or affected by any course of dealing or course of performance.This agreement may be modified by New Mexico State University if the modification is signed by me.Any modification is specifically limited to those policies and/or terms addressed in the modification.
SEVERABILITY CLAUSE
If any provision, term, or clause of this Agreement is declared illegal, unenforceable, or ineffective in a legal forum with competent jurisdiction to do so, this Agreement shall be deemed severable, and all other provisions, terms, and clauses of the Agreement will remain valid and binding on the Parties.
